Understanding and Applying a Duty of Care

CFP®  Professionals owe a Fiduciary Duty when providing Financial Advice to clients.  The 3 prong definition includes a Duty of Loyalty, a Duty to Follow Client Instructions, and a Duty of Care.

Guidance for meeting your Duty of Care points to a consistent process for decision making.  When providing Financial Advice, a 7 step process, and when providing Financial Planning, the 7 step Financial Planning Practice Standards.

In the FPAAZ Boardroom, decision making following a Dynamic Governance model requires well formed proposals before a consent action is likely.  The Duty of Care when applied to proposal building reinforces the value of knowing and purposefully applying the Duty of Care steps.  Our board members implement their Duty of Care as a normal and ordinary course of business before making decisions. 

In the FPAAZ General Circle, the Duty of Care is learned and actively practiced most overtly with our Professional Relations teamwork as we seek to enter into Memorandums of Understanding with other organizations sharing our interest in a more financially literate Arizona.  The Duty of Care has been baked into the teamwork and toolkits around our Professional Development programming calendar.  The Duty of Care and the Duty of Loyalty greatly influenced our Win Win Win Partnership platform.  The Duty of Care underpins our Financial Literacy Course review. 

Within our PDP+ curriculum, financial planning professionals develop the communications, teamwork, and leadership skills needed to successfully implement the Duty of Care consistently when working with fellow professionals and clients.

Within your firm, when you encourage your professionals to volunteer and become active with FPAAZ at any level, they will consistently receive mentoring and coaching that overtly references and acknowledges the Code of Ethics and Standards of Conduct and puts the 3 pillars of the Fiduciary Duty into daily practice.  The Culture of FPAAZ makes your work as an Owner or Manager wanting a consistently compliant company more certain to succeed.
